We operate in accordance with the Data Protection Act, 2012 (Act 843) of the Republic of Ghana, and we are registered as a Data Controller with the Ghana Data Protection Commission.

2.1. Information You Provide

• Businesses: Business name, location, phone number, email address, social media handles, product/service details, target audience, budget information.
• Creators: Full name, username, phone number, MoMo network and number, location, email address, niche, social media handles, follower counts, content descriptions, languages, profile screenshots for verification.
• Communications: Any messages, feedback, or support requests you send to us.

2.2. Information We Collect Automatically

• Usage Data: Pages visited, features used, time spent on the Platform.
• Device Information: IP address, browser type, operating system.
• Location Data: Approximate location based on IP address (not precise GPS).

2.3. Information from Third Parties

• Payment Processors: We receive confirmation of payments and transaction references from Paystack.
• Social Media Platforms: If you choose to verify your account via social media, we may receive basic profile information.

3. How We Use Your Information

We use your personal data for the following purposes:

• To Provide the Service: Connecting Businesses with Creators, processing payments, and facilitating Campaigns.
• To Communicate: Sending you notifications about Campaigns, payments, account updates, and support responses.
• To Verify Identity: Confirming that Creators are who they say they are and that follower counts are accurate.
• To Improve the Platform: Analyzing usage patterns to enhance features and user experience.
• To Comply with Legal Obligations: Meeting our obligations under Ghanaian law, including tax and anti-money laundering requirements.

4. Legal Basis for Processing

Under the Data Protection Act, 2012 (Act 843), we process your personal data based on:

• Contractual Necessity: To fulfill our agreement with you.
• Consent: Where you have given explicit consent (e.g., for marketing communications).
• Legitimate Interest: To operate, improve, and secure the Platform.
• Legal Obligation: To comply with applicable laws.

5. Data Sharing and Disclosure

5.1. Other Users

• Businesses see the Creator's username, niche, location, platform handles, follower counts, and Content.
• Creators see the Business's name, product/service details, Campaign brief, and payout amount. They do not see the Business's full payment details or personal contact information.

5.2. Service Providers

• Payment Processors: Paystack receives payment information necessary to process transactions.
• Communication Providers: SMS and email service providers who help us send notifications.
• Cloud Infrastructure: Google Firebase hosts our data and provides backend services.

5.3. Legal Requirements

We may disclose your information if required by law, court order, or governmental authority.

5.4. Business Transfers

If BusiAds is acquired or merged, your data may be transferred as part of that transaction.

6. Data Security

6.1. We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, loss, or alteration.

6.2. Security measures include:

• Encrypted storage of sensitive data.
• Secure HTTPS connections for all communications.
• Role-based access controls for Platform data.
• Regular security reviews and updates.

6.3. While we strive to protect your data, no method of transmission over the internet is 100% secure. We cannot guarantee absolute security.

7. Data Retention

7.1. We retain your personal data for as long as your account is active or as needed to provide services.

7.2. After account deletion, we may retain certain information as required by law (e.g., tax records) or for legitimate business purposes (e.g., resolving disputes).

7.3. Financial records are retained for a minimum of six (6) years in accordance with Ghanaian tax law.
